Terms of Use

Please read the following Terms of Use ("Terms") carefully before using the services provided on www.kaksya.com or the equivalent Kaksya Mobile Application available on Google Play, Windows Store, or Apple Store (referred to as the "Kaksya App" or "Website"). The Website or App on which these Services are available may together be referred to as the "Platform".

For the purposes of these Terms of Use, the terms “You,” “Your,” or “User” refer to any individual or legal entity that browses the Platform or has subscribed to the Services by registering on the Platform. The terms “We,” “Us,” and “Our” refer to Kaksya.

By using the Platform, you agree to these Terms. We may update these Terms from time to time and will notify you of such changes as soon as possible. Please ensure you read these Terms before continuing to use the Platform.

Acceptance of Terms

These Terms of Use represent a legally binding contract between you, the user, and Kaksya. By using the Platform, you agree to be bound by these Terms. Even if you merely visit the Website or browse any of our available services, you will still be bound by these Terms. If you do not agree with these Terms, you must refrain from using the Platform or accessing the Services.

By using the Platform, you agree to:

  • Provide true, accurate, and complete information when registering and creating login credentials.

  • Ensure you meet the eligibility requirements when opting for paid services or a Pro Account.

  • Maintain and promptly update your login credentials to keep them accurate and current.

  • Acknowledge that Kaksya is not responsible for ensuring your eligibility for services.

  • Obtain parental or legal guardian consent before providing personal information on the Platform if you are under the age of 18.

  • Recognize that Kaksya is not responsible for any misuse of services or accounts.

If any information provided by you is found to be inaccurate or incomplete, or if we reasonably suspect that it is, we reserve the right to suspend or terminate your account and refuse access to any future services.

This document is an electronic record under the Information Technology Act, 2000 and does not require a physical or digital signature.

Eligibility

Only individuals who are competent to contract as defined under the Indian Contract Act, 1872 are eligible to register and become Registered Users on Kaksya. Minors (under the age of 18) are not eligible to use the services without parental or legal guardian consent.

To become a Subscribed User (with access to paid services), you must either:

  • Be a student currently enrolled in a recognized educational institution in India, or

  • Be a qualified professional registered with the appropriate Indian regulatory bodies.

To register, you must fill in the mandatory fields in the subscription form. After completing the registration, you may gain access to free content as a Registered User and opt to purchase a Pro Account.

You will officially become a Subscribed User only after payment has been received in full. A confirmation email will be sent with the plan details and credentials to access the Platform.

Services Provided by Kaksya

To access the full range of content, including tutorial videos, study materials, and other course materials, you must become a Subscribed User. The services available to you may vary based on the subscription plan you select.

The term "Services" refers to all the resources, tutorials, and study materials provided through the Platform, excluding any free demo content available to Registered Users.

You may initially enroll in the free Basic Plan and upgrade to a Pro Account at any time by selecting the appropriate subscription from your user dashboard.

We reserve the right to update, modify, or remove services at our discretion, and any changes to fees or services will be communicated accordingly.

Account, Password, and Security

To access the Platform, you may need to create an account by providing your email address and phone number, and setting a password. You are responsible for maintaining the confidentiality of your account details and ensuring that they remain secure.

If you believe your account has been compromised, you can change your password via the login page.

Third-Party Integrations

We may integrate third-party platforms or services into our Website or App. By using these services, you agree to comply with the third party's terms of service and privacy policy. You also authorize Kaksya to share your personal information with third-party service providers to deliver the services effectively.

Payment Terms

All payments made for Kaksya services are subject to the terms outlined on the payment page during the subscription process. The applicable fees, including taxes, delivery charges for study materials, and any additional costs, will be displayed before the payment is processed.

In the event of a technical error causing incorrect fee amounts to be displayed, Kaksya will notify you and request the correct payment amount. Kaksya uses third-party payment processors and is not responsible for payment failures or errors resulting from issues with the payment gateway or banking services.

Kaksya reserves the right to suspend or deny access to the Platform and its services if payment is not made in full or if there is a payment dispute.

Study Materials

The "Study Materials" include video lectures, question banks, test series, and other educational resources made available as part of the services. These materials are provided on an "AS IS" basis, and Kaksya does not guarantee error-free content.

Kaksya makes no claims regarding rank, success, or marks obtained through using the platform, and the materials are not intended to substitute professional medical advice.

System Requirements

It is your responsibility to ensure that your device meets the minimum system requirements to access the services provided on Kaksya. We cannot be held liable for technical issues such as playback problems if your device is not compatible with the platform's specifications.

Amendment and Termination

Kaksya reserves the right to revise or amend these Terms of Use at any time. We will notify you of any significant changes, and you agree to abide by the updated Terms.

Kaksya may suspend or terminate your access to the Platform or services for any reason, with or without notice, and without liability.
